    This Privacy Policy informs you about what personal data STORMBREAKER VENTURES LTD (also Stormbreaker, «we», «us») collects from you and how and for what purposes it processes them. It applies to all personal data collected upon visiting the website stormbreaker.com as well as all partner websites provided by us, including the chat and mobile applications offered (hereinafter referred to as «Website» or «Websites»).

    General purposes of processing. We use personal information for the purpose of maintaining functional Websites and providing our contents and services. We treat personal information with confidence, care and for the given purpose. By doing so, we adhere to the relevant requirements of the applicable data protection legislation.

    What data we use and why

    Access data. When you visit our Websites, the browser used on your computer or mobile device automatically sends information to the server of our Websites. This information is temporarily stored in a so-called log file. The following information will be collected without your assistance and stored until erasure:

    • name and URL of the retrieved file
    • date and time of retrieval
    • transferred amount of data
    • message about successful retrieval (HTTP response code)
    • browser type and version
    • operating system
    • referrer URL (i.e. the previously visited website)
    • websites accessed by the user’s system through our website
    • Internet service provider of the user
    • IP address and the requesting provider

    We use this log data without assigning them to you or to other statistical profiling and for the purposes of operation, security and optimization of our Websites, but also for the anonymous recording of the number of visitors to our Websites (traffic) and the extent and nature of use of our Websites and services, as well as for billing purposes by measuring the number of clicks received from our partners. Based on this information, we can provide personalised and location-based content, analyze traffic, troubleshoot and improve our services.

    This is also our legitimate interest in the use of these data.

    We reserve the right to retrospectively review the log data if, on the basis of objective evidence, there is a legitimate suspicion of unlawful use. We store IP addresses in the log files for a limited period of time if necessary for security purposes, for the provision of services or the billing of a service, e.g. if you use one of our offers. In addition, as part of your account, we store the date of your last visit (e.g. when registering, logging in, clicking links etc.).

    Data necessary to fulfil our contractual obligations. We process personal data that we need to fulfil our contractual obligations to you, such as first name, surname, address, delivery address, e-mail address, billing and payment data.

    To make it easier for you to buy our products in the future, we save your preferred payment method in your customer account. In addition, we transmit your personal data to banks, payment service providers, financial service providers and credit card companies, depending upon your selected payment method and process, for the processing of the payment and a possible refund of the purchase price.

    The erasure of these data takes place after expiry of the statutory storage periods. Any data associated with a customer account (see below) will be stored as long as this account exists.

    We may also use your personal information to verify compliance with sales requirements and, thus, to fight fraud.

    The legal basis for the processing of these data is the contract with you or our legitimate interest in the fight against fraud.

    Customer account. To set up a customer account, we need some of your contact details from you such as first name, surname, address, e-mail address and telephone number. With new registrations, we collect master data (name, address), contact data (e-mail address) as well as access data (user name and password).

    You can have your customer account erased free of charge at any time using the contact details referred to above.

    After erasing your customer account, we will then erase your personal data stored, as far as we do not have to store them for the execution of orders or due to legal retention obligations.

    The legal basis for processing these data is your consent.

    Newsletter. To subscribe to our newsletter, you need to provide the data requested in the registration process, in particular your e-mail address. Newsletter registrations are logged. After registration, you will usually receive a message to your e-mail address asking you to confirm the subscription («double opt-in»). In general, this is necessary so that third parties cannot register with your e-mail address.

    You can cancel your newsletter subscriptions at any time using the contact details referred to above or revoke your consent to receiving a newsletter at any time and thus unsubscribe from the newsletter free of charge. You will also find an unsubscribe link in every newsletter.

    We store the registration details as long as they are needed for sending the newsletters. The registration logging and the e-mail address are stored as long as there is an interest in having the proof of the originally given consent.

    The legal basis for sending the newsletter is your consent. The legal basis for logging the registration is our legitimate interest in being able to prove that newsletters are sent with your consent.

    Information about same or similar products. Regardless of whether or not you have subscribed to our newsletter, we may use the personal data collected in connection with a completed or cancelled product purchase to inform you about same or similar product offers in the future. You can unsubscribe from receiving such information at any time via the unsubscribe link in the relevant e-mails.

    E-mail and other contacts. If you contact us (e.g. via contact form or e-mail), we will process your details in order to handle your request or notification as well as follow-up questions.

    If data processing is carried out for the purpose of pre-contractual measures upon your request or, if you already are our customer, for the execution of the contract, the legal basis for this data processing is the fulfilment of the contract.

    We only process personal data if you consent to it or if we have a legitimate interest in processing your data. A legitimate interest might lie in responding to your emails or other requests.

    Participation in sweepstakes. If you participate in a sweepstake organized by us, we will process your data in order to conduct the competition and send notification of a prize (via e-mail or social networks).

    The legal basis for processing your data is your consent to participate in the competition.

    Cookies. We use the so-called cookies in order to simplify the use of the services and to obtain information for the purpose of improving the services.

    In particular, we use the so-called session cookies to optimize our Websites. A session cookie is a small text file that is sent by the respective servers when visiting a website and stored on your hard disk. This file contains a so-called session ID, with which various requests from your browser can be assigned to one session. Among other things, they allow you to use the shopping cart feature across several pages.

    We also use a small amount of persistent cookies (also small text files stored on your device) that remain on your device and allow us to recognize your browser the next time you visit our Websites.

    Our legitimate interest for the use of cookies is to make our websites more user-friendly, efficient and secure.

    The cookies contain the following data and information:

    Once the cookie is activated, it will be given an identification number and your personal data will not be assigned to this identification number. Your name, IP address or similar data that would allow the cookie to be associated with you will not be included in the cookie. Based on the cookie technology, we only receive anonymized or pseudonymized information, for instance: which pages of our Websites were visited, which products were viewed etc.

    You can set your browser in a way that it shows notifications about the use of cookies in advance and you can decide on a case-by-case basis whether you reject the use of cookies for certain cases or in general or whether you block cookies completely. This may limit the functionality of the Websites.

    Social Plugins. Our Websites use social plugins (hereinafter «plugins») of various social networks, such as Facebook and Twitter (hereafter «networks»), to promote our company. The underlying commercial purpose is to be regarded as a legitimate interest. The respective providers guarantee compliance with data protection rules.

    The integration of these plugins is done by means of the so-called double click method to best protect visitors of our Websites. The plugins are marked with a logo or a text hint. When you visit a page that contains such a plugin, your browser establishes a direct connection to the network servers. The content of the plugin is transmitted by the networks directly to your browser and integrated into the website. By integrating the plugins, the networks receive the information that you accessed the corresponding page. If you are logged in to one of the networks, the networks might associate your visit with your account. When you interact with the plugins, the corresponding information is transmitted directly from your browser to the networks and stored there.

    The purpose and scope of the data collection and the further processing and use of the data by the networks, as well as your rights in this regard and setting options for the protection of your privacy can be found in the privacy policies of the respective networks. If you do not want the networks to collect information about you through our Websites, you must log out of the networks before visiting our Websites. Even if you are not logged in to a network, sites with active network elements send data to the networks. The networks can set a cookie with an identifier that can be valid for a longer period each time the Websites are retrieved. Since your browser sends this cookie every time you connect to a network without asking you for permission, the network could then profile what websites the user associated with the given identifier visited. It would then also be possible to assign this identifier to someone when later logging in to the networks.

    Rights of data subjects. You have the following rights regarding your personal data. If you wish to assert these rights, please send your request by e-mail or by mail with a clear identification of your person to the address specified above.

    Request information about your personal data processed by us. In particular, you can ask for information on the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned retention period, the right to rectification, deletion, limitation of processing or opposition, the existence of a right to appeal, the source of your data, if not collected from us, as well as the existence of automated decision-making including profiling and, where appropriate, meaningful detailed information thereof;

    Demand the completion or rectification of incorrect personal data stored by us immediately;

    Demand the erasure of your personal data stored by us except where the processing is required for the exercise of the right of freedom of expression and information, for the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims;

    Demand limitation of the processing of your personal data if (i) the accuracy of the data is disputed by you, (ii) the processing is unlawful, but you reject the erasure, (iii) we no longer need the data but you need it to assert, exercise or defend your rights, or (iv) you have objected to the processing, as long as it is not certain that the legitimate interests of our company outweigh yours;

    Obtain your personal data provided to us in a structured, common and machine-readable format or to request the transfer to another controller;

    Revoke your consent given to us at any time. As a result, we are not allowed to continue the data processing based on this consent in the future;

    Lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or work or our company headquarters.

    Right to object. If your personal data are processed with legitimate interests, you have the right to file an objection to the processing of your personal data should there be reasons for this arising from your particular situation or if the objection is directed against direct mail marketing. In the latter case, you have a general right to object without specifying any particular reason or situation.

    Data security. We make every effort to ensure the security of your data within the framework of applicable data protection laws and technical possibilities.

    We will be transmit your personal data encrypted. This applies to your orders and also to the customer login. We use the SSL coding system (Secure Socket Layer), yet we point out that data transmissions over the Internet (e.g. When communicating by e-mail) might entail security gaps. A full protection of the data from access by third parties is not possible.

    To safeguard your data, we maintain technical and organizational security measures that we always adapt to state-of-the-art technology.

    We also do not guarantee that our offer will be available at specific times as disturbances, interruptions or failures may occur. The servers we use are regularly backed up.

    Transfer of data to third parties. Basically, we only use your personal data within our company.

    However, we may transmit your personal data to third parties for the purpose of processing the contract between you and us (e.g. payment processor).

    The personal data collected in connection with a product purchase can be used to inform you about same or similar products in the future. You have the option to unsubscribe from receiving such information at any time.

    If we outsource certain parts of our data processing (e.g. to a collection agency), we contractually obligate the contractor(s) to use personal data only in accordance with the requirements of the applicable data protection law and to ensure the protection of the data subject’s rights.

    Apart from the cases mentioned in this statement, there is no data transfer to third parties outside Switzerland and the European Economic Area (EEA) taking place nor planned.

    Modification of this data protection policy. We reserve the right to change this data protection policy at any time and without giving notice. Changes will be published on our websites and take effect upon their activation.
